  1. THESE TERMS AND CONDITIONS

1.1. What these terms and conditions cover: These terms and conditions are the terms on which we supply the AssetID services to you. They also apply to your use of the assetid.com.gh website. The AssetID services are described in paragraph 8.

1.2. Why you should read them: Please read these terms carefully before you sign up for the AssetID services. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what our liability to you is, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or you think these terms require any changes, please contact us to discuss your concerns.

By using the assetid.com.gh website or signing up for any of the AssetID services you are entering into a contract with us on these terms and conditions.

  1. INFORMATION ABOUT US AND HOW TO CONTACT US

2.1. Who we are: ‘AssetID’ is a project of Accessplus Communications Ltd and PAD-ARM. Accessplus Communications Ltd operates this website and will be providing the AssetID services to you. Accessplus Communications Ltd is a company established in Ghana with a company registration number of CS630742015. Our office is located at First Floor, Friendly Heights Building, Mahama Road, TseAddo, Accra, Ghana. In these terms and conditions, “we”, “us” and “our” therefore refer to Accessplus Communications Ltd.

2.2. How to contact us: You can contact us by sending an email to us at support@assetid.com.gh. This contact email address can be used in relation to reporting any issues you have had in relation to concluding your contract for AssetID services with us or in relation to any of these services.

2.3. How we may contact you: If we have to contact you we will do so by writing to you at the email address you have saved on your AssetID account. Please ensure that this is the correct email address.

2.4. Writing includes emails: When we use the words “writing” or “written” in these terms, this includes emails.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE AND SIGNING UP FOR THE ASSETID SERVICES AS THEY CONTAIN LEGAL RIGHTS AND OBLIGATIONS.

  1. REGISTRATION PROCESS FOR ASSETID SERVICES AND OUR CONTRACT WITH YOU

3.1. Process for registering to receive the AssetID services:

3.1.1. You need to register online at assetid.com.gh to create an AssetID account with us and receive the AssetID services. The AssetID services allow you to register your personal property in our database. More details of these services can be found in paragraph 8.1.

3.1.2. Once you have filled in our online registration form we will send you an activation link to the email address and/or the mobile number you provide.

3.2. Activation Link: You must use the activation link we send you to activate your AssetID account within 72 hours of when we send it to you. If you don’t do this then you must go through the registration process again. Once your account has been activated and the remaining part of the registration process has been completed, you will receive a welcome email from us to the email address you have provided.

3.3. When does the contract for the AssetID services come into existence? The contract in respect of the AssetID services will only come into existence between us once you have used the activation link to activate your AssetID account within the 72 hour period referred to in paragraph 3.2 above.

3.4. How to correct errors in the registration process: If you have made a mistake to your personal details during the registration process, you can either re-register for the AssetID services or update your personal details in your AssetID account.

  1. INFORMATION NEEDED TO PROVIDE THE ASSETID SERVICES

Information needed and what will happen if you do not give us the required information: We need certain information from you as part of the registration process so that we can supply the AssetID services to you. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may end the contract (and paragraph 14 will apply). We will not be responsible for supplying the AssetID services late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.

  1. ACCESSING THE TERMS OF THE CONTRACT BETWEEN US

You can access the terms of your contract with us for the applicable AssetID services on the AssetID website.

  1. LIMITATIONS ON REGISTERING FOR AND RECEIVING THE ASSETID SERVICES

6.1. AssetID services for personal use only: You may only use and access the AssetID services, and the assetid.com.gh website on your own behalf, for your personal use and not on behalf of anyone else. If you are a business, you may not use the assetid.com.gh website to provide services to third parties.

  1. CHANGES TO THESE TERMS AND CONDITIONS OR THE ASSETID SERVICES

7.1. Minor changes to the AssetID services: We may make minor changes to the AssetID services to reflect changes in any relevant laws or regulatory requirements and/or to implement minor technical adjustments and improvements to the way we deliver the AssetID services to you. These minor changes will not adversely affect your use of the AssetID services in any significant way.

7.2. More significant changes to the AssetID services or to these terms and conditions: We may change these terms and conditions or make more significant changes to the AssetID services than those set out above. If we do this we will notify you of the changes by email. We will try to give you as much notice as we can of the proposed changes. We may be unable to give notice if we need to make any urgent changes.

7.3. Cancellation of the AssetID services: If the changes we may make in paragraph 7.2 above are significant and adversely affect your use of the AssetID services and as a result, you don’t want to continue to receive the AssetID services affected by the changes, then you can cancel your contract with us by letting us know in writing by e-mail to support@assetid.com.gh.

  1. ASSETID SERVICES

PLEASE READ THESE PARAGRAPHS CAREFULLY AS IT EXPLAINS WHAT THE ASSETID SERVICES ARE, WHAT EXCLUSIONS APPLY AND WHAT YOUR OBLIGATIONS ARE IN RELATION TO THOSE SERVICES.

8.1. AssetID services: Once we accept your registration for the AssetID services, we agree to provide the following services to you for free under these terms and conditions.

8.1.1. We will allow you to register information about you and your personal property in our database. You can add, remove, edit or view that information at any time.

8.1.2. We will make that information available to other 3rd parties. This includes, but not limited to, the police forces who may use the information to help reunite you with your property if it is lost or stolen. (Please refer to our  privacy policy for more details about how the information may be used or shared.)

8.2. You must only provide us with information about property that you own or for which you are contractually or legally responsible, and you are responsible for keeping that information accurate and up to date.

8.3. Your use of the AssetID services does not give you any special ownership, storage or recovery rights in relation to the property that you register. If the property is recovered by an organization which uses our services, the return of that property to you by that organization will be subject to their own policies and procedures.

8.4. The fact that you have registered an item on assetid.com.gh does not mean that it is not at risk of theft or that it will be recovered and returned to you if it is lost or stolen. The police may or may not use our database on any particular occasion.

8.5. Other services: We might decide to make other free or paid-for services available to you through the website. If we do that, you may be asked to agree to additional terms and conditions relating to your use of those services.

  1. AVAILABITY OF ASSETID SERVICES

9.1. Whilst we will try to make sure that the AssetID services are available for use as much as possible we cannot guarantee their availability. You will appreciate that we need to take the website and the AssetID services down from time to time for maintenance. We will try to do this at times when we are expecting low usage but cannot guarantee that this will be the case.

9.2. No software provider can fully guarantee that its website and/or content is completely virus and bug free, but you should be aware that we are committed to trying to make the AssetID services as virus and bug free as we can and use suitable virus checking software in relation to these services, the AssetID website and its content. You should, however, still use appropriate virus checking software on the devices you use to access the AssetID website and the AssetID services.

  1. ACCURACY OF INFORMATION WE PROVIDE

It is important to us that the information we supply to you is as accurate as possible and we use reasonable efforts to verify its accuracy. We cannot guarantee that it is completely accurate, however. Also, as you will appreciate, some of this information comes from other businesses and sources. Neither we, nor any third parties used to provide the AssetID services have any control over the content of such information and are not responsible if it turns out to be inaccurate.

You will appreciate that whilst some of the AssetID services will provide information to you this is provided for your guidance and information only.

  1. CHARGES FOR THE ASSETID SERVICES

AssetID services provided at cost: The AssetID services will be provided to you at a cost indicated on the AssetID website. If we decide to offer any free services in addition to the paid-up services, then additional or alternative terms will apply.

  1. DURATION OF ASSETID SERVICES

12.1. When does your access to the AssetID services start? Paragraph 3.3 makes it clear when your contract for AssetID services begins. You will be given access to the AssetID services on the assetid.com.gh website and you will start to receive those services from that point. You have a right to cancel your contract for these services if you change your mind. Further details of this cancellation right is set out in paragraph 13 below.

12.2. Continuation of the AssetID services: We will automatically continue to provide the AssetID services until they are cancelled in the way set out below in paragraph 13 or paragraph 14.

  1. YOUR RIGHTS TO END THE CONTRACT WITH US

How to cancel the AssetID services: If you no longer wish to receive any AssetID services you may tell us to cancel them by sending a request to us at support@assetid.com.gh. We will administer this change within a reasonable time.

  1. OUR RIGHTS TO END THE CONTRACT WITH YOU

14.1. When we may end our contract with you: We may cancel your registration on the assetid.com.gh website and cancel your receipt of any of the AssetID services:

14.1.1. because of your misuse of the AssetID services. Misuse of the AssetID services means use of the AssetID services in a way which is not permitted by these terms and conditions or where there is fraud or reasonable grounds to suspect fraud; or

14.1.2. if we stop providing the AssetID services. We will let you know at least one calendar month in advance of our stopping providing the AssetID services or the assetid.com.gh website; or

14.1.3. if we wish to change the terms on which we provide the AssetID services and you do not agree to those changes; or

14.1.4. if any payment that you owe us is declined, rejected or reversed.

  1. SECURITY

15.1. Rights to access the AssetID services and website is personal to you: Your right to access the AssetID services is personal to you. You must not allow any other person to have access to your AssetID account or the AssetID services using your username and password. You must keep your username and password confidential.

15.2. Ability to suspend your access to the AssetID services and website: We reserve the right to suspend your access to the assetid.com.gh website and the AssetID services if at any time we consider that there is or is likely to be a breach of security or your use of the assetid.com.gh website is in any way detrimental to us or anyone else.

15.3. Obligations to change passwords: We reserve the right to require you to change any or all of the passwords used by you in connection with the assetid.com.gh website and/or the AssetID services.

  1. COPYRIGHT, TRADEMARKS AND OTHER INTELLECTUAL PROPERTY RIGHTS

16.1. Your acknowledgement that we own copyright etc. in our website and the AssetID services: You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in the assetid.com.gh website, AssetID services and all aspects of them are owned by us, those businesses who provide services to us as part of the AssetID services or our other suppliers.

16.2. Your ability to take copies: You may take reasonable copies of the information provided as part of the AssetID services solely for your own personal use. You may use it on a commercial basis or provide it to anyone else based upon an express written approval from us. In such situations, different terms of use will apply. You may not sell it on, republish it, redistribute it, copy (except as permitted above) or adapt it.

  1. OUR LIABILITY TO YOU

PLEASE READ THIS PARAGRAPH CAREFULLY AS IT EXPLAINS WHAT LIABILITY WE HAVE TO YOU AND WHAT EXCLUSIONS APPLY

17.1. When are we liable to you: If we do not comply with the terms of our contract with you or we do not use reasonable care and skill in providing the AssetID services to you then we will be responsible for the loss and damage which is a foreseeable result of this breach. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

17.2. No liability where the loss or damage is not foreseeable: We are not responsible for any loss or damage which is not foreseeable.

17.3. We are not liable for business losses: We only supply AssetID services for domestic and private use. If you use the AssetID services for any commercial, business or re-sale purpose we will have no liability to you for any loss of profits, loss of or damage to reputation, loss of contracts, loss of opportunity, loss of business, loss or depletion of goodwill, increased overheads or administration expenses, management time, loss of savings.

  1. DATA PROTECTION AND PRIVACY POLICY

18.1. What personal information we collect and how we use it: We will collect personal information in connection with your use of the AssetID services and the assetid.com.gh website. Our privacy policy has details of what information we collect, what we do with that information, what information we provide to 3rd parties in response to verification requests and when reuniting your lost/stolen properties to you, and any other related matters.

  1. QUERIES AND COMPLAINTS

How to complain: If you have any complaints in relation to the AssetID services then please contact us at support@assetid.com.gh.

  1. LINKS TO OTHER WEBSITES

To provide increased value to you, we may provide links to other websites or resources for you to access. You can choose whether or not to access these links. As you will appreciate, once you have left our website we are not responsible for the availability or content of these external websites or resources. We do not review or endorse the content of these websites. If you provide your personal details to these external websites then the use of these personal details will be governed by the privacy policy of that website and not our privacy policy.

  1. MISCELLANEOUS

21.1. Circumstances beyond our control: We shall be under no liability for any delay or failure to deliver the AssetID services or otherwise perform any obligation under these terms and conditions if the delay or failure is caused by circumstances beyond our reasonable control.

21.2. What happens if a court finds any part of this contract to be illegal: If a court finds part of this contract illegal, the rest will continue in full force because each of the paragraphs of these terms and conditions operates separately.

21.3. No rights given to third parties: These terms and conditions do not give any rights to anyone who is not a party to them.

21.4. Which law applies and where you can bring court action: These terms and conditions are governed by the laws of the Republic of Ghana and you can bring legal proceedings in respect of the products in the courts of Ghana.

21.5. Transfer of rights under this contract: We may transfer our rights and obligations under this contract to another organisation. We will contact you to let you know if we plan to do this. If you are unhappy with the transfer you may contact us to end the contract within four weeks of us telling you about.
